Terms of use

The German version of these terms is the legally binding one.

1. Scope and provider

These terms apply to the use of the wofoto app for iOS and Android. The provider is [TODO: provider name], see the imprint.

2. What wofoto does

wofoto lets you give photos and videos in your device library titles and tags and search for them. wofoto is a local tool. It has no user account and no cloud backup. Labels are stored only on your device. wofoto never copies or changes your photos and videos.

3. Licence

We grant you a simple, non-transferable right to use the app for personal, non-commercial purposes on devices you control. You may not reverse-engineer, resell or misuse the app, except where the law expressly allows it.

4. Free version and wofoto Pro

• Free: you can label up to 100 photos or videos. Export and import are always free.
• wofoto Pro removes this limit and is available as a monthly subscription, an annual subscription or a one-time lifetime purchase.

Prices are shown in the app and in the store before you buy. The purchase contract, payment and billing are handled by Apple (App Store) or Google (Google Play) under their terms.

5. Subscriptions, cancellation and restoring purchases

• Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• You manage and cancel subscriptions in your Apple ID or Google Play account settings, not in the app. Deleting the app does not cancel a subscription.
• The lifetime purchase is paid once and does not renew.
• On a new device or after reinstalling, use Settings → Restore purchases with the same Apple ID or Google account.
• Refunds are handled by Apple or Google under their rules.

6. Right of withdrawal

Purchases are made through Apple or Google. Any statutory right of withdrawal for consumers applies according to their terms and information during the purchase. [TODO: check whether a separate withdrawal notice (Widerrufsbelehrung) is required]

7. Your data and backups

Because labels are stored only on your device, they can be lost if you uninstall the app, reset or lose your device. You are responsible for exporting your labels regularly (Settings → Export labels) and keeping the backup files safe. Details on data processing are in the privacy policy.

8. Availability and changes

We develop wofoto further and may change features if this is reasonable for you. We do not guarantee that the app is available at all times or works with every device and operating system version.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), limited to the typical, foreseeable damage. For loss of data, our liability is limited to the effort that would have been needed to restore it from regular backups. Statutory consumer rights, including warranty rights for digital products, remain unaffected.

10. Apple Standard EULA

If you obtained wofoto from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies. If these terms conflict with it, these terms prevail where Apple allows this.

11. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.

12. Changes to these terms

We may change these terms for valid reasons, for example a change in the law or new features. We will inform you of significant changes in good time in the app or on this website.
